These Terms of Use (“Terms”) govern your use of our website **[www.nativfresh.com](http://www.nativfresh.com)** (the “Website”) and the **NativFresh** mobile application for smartphones and handheld devices (the “App”). Collectively, the Website, App, and any subdomains are referred to as the “Platform.”

Please read these Terms carefully before using our services. By installing, downloading, registering, or simply using the Platform, you confirm your acceptance of these Terms, along with other applicable NativFresh policies (including but not limited to the Cancellation & Refund Policy, Privacy Policy, and Cookies Policy), all of which form a legally binding agreement. If you do not agree, please refrain from using our services and uninstall the App.

The Platform is owned and operated by **SHREE MUKKOTI FOODS PRIVATE LIMITED**, a company incorporated under the Companies Act, 2013, with its registered office at 2-1251/4, B.V.Reddy Colony, Nikhilanand Apartments, Chittoor, Andhra Pradesh, India, 517001.

In these Terms:

* “You” or “User” refers to any individual or entity using the Platform to browse, purchase, or subscribe to our services.

NativFresh is engaged in the business of delivering fresh, natural, and responsibly sourced farm products, offered both on a subscription and non-subscription basis. Buyers (“Customers”) may browse and place orders for products (“Products”) available on the Platform, and NativFresh will arrange delivery of such orders in specified serviceable locations (“Delivery Services”).

2) AMENDMENTS

We may update or modify these Terms at any time. Changes will be posted on the Platform, and it is your responsibility to review them periodically. Continued use of the Platform following such updates constitutes acceptance of the revised Terms.

As long as you comply with these Terms, NativFresh grants you a limited, revocable, non-transferable, non-exclusive license to access and use the Platform.

By accepting these Terms, you also agree to abide by other applicable NativFresh policies posted on the Platform.

3) USE OF PLATFORM AND SERVICES

3.1 Pricing

* Products are generally sold at their Maximum Retail Price (MRP), unless specified otherwise. Prices may change with or without prior notice.
* The price applicable to your order will be the one valid on the date of delivery.

3.2 Storage & Handling

* Dairy products must be refrigerated at the recommended temperature stated on the packaging. Complaints regarding quality will only be considered if proper storage conditions are followed.
* Products such as eggs should be consumed as per the packaging instructions. Responsibility for quality in such cases lies with the respective producer.

3.3 Product Information

* Images and details on the Platform are for reference only. Actual packaging, size, or content may vary. Customers are advised not to rely solely on the digital descriptions.

3.4 Third-Party Products

* For products supplied by third parties, NativFresh assumes no liability for errors, omissions, or deficiencies attributable to the manufacturer.

3.5 Complaints

* Any quality or service-related issues may be reported to us. We will provide necessary details such as manufacturer/vendor information to facilitate resolution.

3.6 Communication

* We may contact you through phone, SMS, WhatsApp, email, or other channels regarding orders, transactions, feedback, or support. Calls may be recorded for training and quality purposes.

3.7 Deliveries

* Delivery timelines are estimates and may vary due to external factors. Customers will be notified in case of delays.
* Specific time-slot requests cannot always be guaranteed.

3.8 Acceptable Use Policy

You agree not to misuse the Platform. Specifically, you must not:

* Post or share unlawful, offensive, defamatory, or harmful content.
* Infringe upon third-party rights, including intellectual property or privacy.
* Mislead or deceive other users.
* Interfere with Platform security, probe vulnerabilities, or attempt unauthorized access.
* Impersonate others, forge identities, or misrepresent your affiliation.
* Upload malicious code or engage in activities that disrupt Platform operations.
* Overload our systems with unreasonable demands or abusive use.
* Publish defamatory or derogatory statements about NativFresh or its affiliates.

Violations may result in suspension or termination of your account.

4) ACCOUNT REGISTRATION

* To use the Platform, you must register for a **NativFresh Account** with accurate and up-to-date information.
* Accounts may be suspended or terminated if we suspect misuse, non-compliance with these Terms, or actions that could cause legal or financial liability.
* Products purchased are intended strictly for personal use, not for resale.

5) BOOKINGS AND FINANCIAL TERMS

5.1 Orders & Subscriptions

* Orders may be placed on a one-time or subscription basis. Order acceptance is subject to stock availability and our discretion.
* We operate on a prepaid model. Customers must ensure sufficient wallet balance before placing an order. Insufficient funds may result in cancellation.

5.2 Payments

* Payments must be made in **Indian Rupees (INR)** through approved methods such as credit/debit cards, net banking, UPI, or other RBI-authorized payment services.
* Payment gateways such as Razorpay and Juspay may be used for secure transactions. Their terms and conditions apply.
* NativFresh is not a bank or financial institution; we act only as a facilitator of electronic payments.

5.3 Price Changes

* Prices may change at any time, but orders already placed will be charged as per the confirmed booking.
* For subscriptions, price adjustments may be reflected in subsequent billing cycles.

5.4 Refunds & Chargebacks

* Refunds will be processed in cases of non-delivery or valid disputes, subject to investigation.
* If a transaction fails due to technical issues but funds are debited, the amount will typically be reversed by the bank. Delays must be taken up directly with the issuing bank.
